Right of Withdrawal for Consumers

Right of Withdrawal
You have the right to withdraw from this agreement within 60 days without providing any reason.
The withdrawal period is 60 days from the date:

  • On which you, or a third party designated by you (not the carrier), take possession of the goods, provided that you have ordered one or more goods under a single order and these are delivered uniformly;
  • On which you, or a third party designated by you (not the carrier), take possession of the last good, provided that you have ordered one or more goods under a single order and these are delivered uniformly.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this agreement. You can do so by emailing info@bylivia.co.uk.
You may use the attached withdrawal form, although this is not mandatory.
To respect the withdrawal period, it is sufficient that you send your notification of exercising the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal
If you withdraw from this agreement, we will refund all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a delivery method other than the least expensive standard delivery we offer), without undue delay and in any event within 14 days from the day we receive the notification of your withdrawal.
We will use the same payment method for the refund that you used for the original transaction, unless you have expressly agreed otherwise; in no case will this refund incur extra costs for you.
We may withhold the refund until we have received the returned goods, or until you have provided evidence that you have sent the goods back, whichever comes first.

You must return the goods without delay and in any event within 14 days from the date you informed us of your withdrawal. The deadline is met if you send back the goods before the 14-day period expires.
You will bear the direct costs of returning the goods.
You are only required to pay for the reduction in the value of the goods when this reduction in value is due to unnecessary handling on your part, and this will be determined after checking the nature, characteristics, and functioning of the goods.

Exclusions and Expiration of the Right of Withdrawal
The right of withdrawal does not apply to contracts:

  • For the supply of goods that are not pre-manufactured and for their production based on consumer specifications or clearly tailored to personal needs;
  • For the supply of goods that are likely to deteriorate or expire rapidly;
  • For the supply of alcoholic beverages, where the price was agreed upon at the time of the contract, and delivery can only take place 30 days after the contract is concluded, with the value dependent on market fluctuations that the entrepreneur cannot control;
  • For the supply of newspapers, magazines, or periodicals, with the exception of subscriptions.

The right of withdrawal expires early for contracts:

  • For the supply of sealed goods that are not suitable for return due to health or hygiene reasons, once the seal is broken after delivery;
  • For the supply of goods that, by their nature, have been inseparably mixed with other goods after delivery;
  • For the supply of audio and video recordings or computer software in sealed packaging if the seal was broken after delivery.
